Acceptance of Terms

By accessing, downloading, or using any services provided by Deucetek LLC ("Deucetek," "we," "us," or "our"), including our mobile applications, SaaS products (Zynthex AI and Cyber Sensai), software development services, and websites (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not access or use our Services.

Service Definition

Our Services include:

• Twenty-two (22) mobile applications across games, communication, dating, and short reels categories
• Zynthex AI, our AI and machine learning powered application failure predictability tool
• Cyber Sensai, our content moderation system powered by thirteen (13+) different AI models
• Software development and consulting services
• Associated websites including deucetek.com and individual product sites

Entity and Contracting Party

These Services are provided by Deucetek LLC, a limited liability company organized under the laws of Georgia, USA, located at 135 Technology Pkwy STE 100, Norcross, GA 30092.

2. Age Requirements and Eligibility

Minimum Age

You must be at least 18 years old to use our Services. For our dating applications specifically, users must be 18 years or older without exception. We reserve the right to request proof of age at any time and will terminate accounts of underage users immediately upon discovery.

Age Verification

By using our Services, you represent and warrant that you meet the age requirements. Creating a profile that misrepresents your age is strictly prohibited and will result in immediate account termination.

3. Account Registration and Security

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and current

Account Termination Rights

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Creating false or misleading profiles
• Attempting to circumvent our security measures

4. User Conduct and Prohibited Activities

General Prohibitions

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Transmit or upload any harmful, threatening, abusive, or harassing content
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Services or servers
• Attempt to gain unauthorized access to any part of the Services
• Use automated systems to access the Services without permission

5. Virtual Content and In-App Purchases

No Monetary Value

Virtual items, currency, and digital goods in our applications ("Virtual Content") have no monetary value and cannot be exchanged for real money, goods, or services. ALL PURCHASES OF VIRTUAL CONTENT ARE FINAL AND NON-REFUNDABLE except where required by applicable law.

License Grant

When you purchase Virtual Content, you receive a personal, non-exclusive, non-transferable, revocable, limited license to use such content solely within the applicable Service. You have no ownership rights in Virtual Content.

Purchase Limits

We reserve the right to impose limits on Virtual Content purchases and account balances at our discretion.

6. AI/ML Services Disclaimers

Zynthex AI Disclaimers

AI-GENERATED FAILURE PREDICTIONS ARE PROBABILISTIC ESTIMATES BASED ON HISTORICAL DATA AND SHOULD NOT BE RELIED UPON AS DEFINITIVE FORECASTS. You acknowledge that:

• Predictions may be inaccurate or incomplete
• You must implement independent monitoring systems
• We are not liable for system failures not predicted
• False predictions may result in unnecessary actions
• Model accuracy may change with updates

Cyber Sensai Disclaimers

AUTOMATED CONTENT MODERATION PROVIDES SCREENING BUT MAY PRODUCE FALSE POSITIVES OR MISS HARMFUL CONTENT. You acknowledge that:

• Human review is required for final moderation decisions
• AI models may exhibit bias or make errors
• We are not liable for content that passes filters
• Legitimate content may be incorrectly flagged
• You remain responsible for content compliance

7. User-Generated Content

Content License

By submitting content to our Services, you grant Deucetek a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

Content Responsibilities

You represent and warrant that:

• You own or have rights to all content you submit
• Your content does not violate any laws or rights
• Your content is accurate and not misleading
• You will not submit harmful or inappropriate content

Content Moderation

We reserve the right to review, screen, delete, or modify any user content at our sole discretion without notice. We may use automated systems and human moderators for content review.

8. Dating Services Specific Terms

No Guarantees

We make no representations about:

• The number or quality of matches
• The authenticity of user profiles
• The success of any relationships
• The conduct of other users

Background Checks

DEUCETEK DOES NOT CONDUCT CRIMINAL BACKGROUND OR IDENTITY VERIFICATION CHECKS ON USERS. We make no representations or warranties about user conduct, identity, or intentions.

Safety Guidelines

You acknowledge sole responsibility for your interactions with other users. Exercise caution when meeting in person and never send money to other users.

9. Privacy and Data Usage

Data Collection

Our data practices are governed by our Privacy Policy. By using our Services, you consent to data collection and usage as described therein.

AI Model Training

For our SaaS products, we may use aggregated and anonymized data to improve our AI models, unless you opt out through your account settings.

Location Services

Some Services may track your location. You can disable location services but this may limit functionality.

10. Intellectual Property Rights

Our IP

Deucetek retains all rights, title, and interest in and to the Services, including all software, content, designs, and trademarks. Nothing in these Terms grants you any rights to our intellectual property except as expressly stated.

We respect intellectual property rights and will respond to valid DMCA takedown notices. Repeat infringers will be terminated.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEUCETEK'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) $200 OR (B) THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Essential Basis

You acknowledge that these limitations are an essential basis of our agreement and that we would not provide the Services without them.

13. Indemnification

You agree to defend, indemnify, and hold harmless Deucetek, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another
• Your content or activities
• Your interactions with other users

14. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Georgia without regard to conflict of law principles.

Arbitration

Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association. The arbitration shall be conducted in Gwinnett County, Georgia.

Class Action Waiver

YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS PART OF ANY CLASS OR REPRESENTATIVE ACTION.

Small Claims

Either party may bring qualifying claims in small claims court in Gwinnett County, Georgia.

15. Service Modifications and Termination

Modification Rights

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without notice or liability.

Beta Features

Features labeled as "beta," "preview," or similar are provided without warranties and may be discontinued at any time.

Termination Effects

Upon termination, your license to use the Services ends immediately. We may delete your data and content without notice.

16. General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and Deucetek regarding the Services.

Severability

If any provision is found unenforceable, the remaining provisions shall continue in full effect.

No Waiver

Our failure to enforce any right or provision shall not constitute a waiver.

Assignment

You may not assign these Terms. We may assign our rights and obligations without restriction.

Survival

Provisions regarding intellectual property, indemnification, disclaimers, limitations of liability, and dispute resolution shall survive termination.

Force Majeure

We shall not be liable for delays or failures due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
